Can the President of Nigeria Suspend a Governor? What the Constitution Says

Recently, President Bola Tinubu declared a state of emergency in Rivers State due to ongoing political problems and damage to national assets. 

Along with this, he suspended Governor Sim Fubara, Deputy Governor Ngozi Odu, and other elected officials. He appointed retired Vice Admiral Ibok-Ete Ibas to manage the state for now.

The Nigerian Constitution allows the president to declare a state of emergency in extreme situations to keep the public safe and maintain order. This power has strict rules to prevent misuse.

When Can a State of Emergency Be Declared?

The president can declare a state of emergency in situations like:

  • War or threat of invasion.
  • Complete breakdown of law and order.
  • Natural disasters like floods or earthquakes.
  • Other serious threats to the country.
  • At the request of a state governor, if most of the state’s legislature agrees.

How Is a State of Emergency Declared? 

The president must officially announce the state of emergency and inform the National Assembly, which includes the Senate and the House of Representatives. This assembly must agree by a two-thirds majority. If they don’t agree within a specific time, the state of emergency cannot continue.

Is Suspending Elected Officials Allowed? 

The big question here is whether the president can suspend elected officials like the governor during a state of emergency. Legal experts argue that the Constitution does not give the president the power to do this.

Human rights lawyer Inibehe Effiong and attorney Ridwan Oke both say that the president can declare an emergency but cannot suspend elected officials.

They suggest that the president should take back his decision to suspend the officials and appoint a sole administrator, as the constitution doesn’t support these actions.

This situation in Rivers State brings up important questions about the limits of presidential powers during an emergency and the rights of elected officials.
