UK Family Visa: Who Can Apply, Extend, or Switch?

If you’re looking to join a loved one in the UK and stay for more than six months, the UK Family Visa might be the route for you. It’s not just about couples, this visa covers a wider circle of family ties and can lead to long-term settlement in the country. 

But the rules can be confusing, especially when it comes to who qualifies, how to extend your stay, or whether you can switch to this visa from another. Let’s break it down simply.

Who can apply for a UK family visa?

The UK Family Visa is for people who want to live with a close family member who is either a British citizen, settled in the UK, or has refugee or humanitarian protection. You can apply from outside the UK if you’re planning to live with:

  • Your spouse or civil partner
  • Your fiancé(e) or proposed civil partner
  • Your child
  • Your parent
  • A relative who will be providing long-term care for you

This visa is for those looking to live in the UK long-term. If you’re only visiting for a few months, say, for a wedding or a holiday, you’ll need to look at the Visitor or Marriage Visitor visa instead.

Can you extend your stay?

Yes, if you’re already in the UK on a family visa, you can apply to extend your stay before your current visa runs out. The process is straightforward if you’re staying with the same family member you originally applied with.

But here’s something to keep in mind, even if your extension is granted, your new visa will only cover the remaining time of your initial permission plus up to 28 extra days. 

This means your entire stay can’t be endlessly extended, at some point, you’ll either need to apply for settlement or leave the UK.

For those who’ve lived in the UK for several years but don’t qualify for a family visa, there may still be hope under the ‘private life’ route.

Switching to a family visa from inside the UK

Some people come to the UK on different visas and later want to stay with a loved one. Switching to a family visa is allowed in many cases as long as you apply before your current visa expires.

You can switch if you’re staying with:

  • A spouse or civil partner
  • A parent
  • A child

However, if you entered the UK on a short-term visa such as a visitor visa, you’ll usually have to leave the UK and apply from your home country. Exceptions include those who are:

  • In the UK as a fiancé(e) or proposed civil partner on a six-month visa
  • Waiting for a divorce or a family court ruling

Costs to expect

Applying for a family visa isn’t cheap, and the total cost includes more than just the application fee.

Here’s what most applicants will pay:

  • Outside the UK: £1,938
  • Inside the UK: £1,321

If you’re being cared for by a relative, the fees may vary depending on their immigration status. On top of that, you’ll need to pay a healthcare surcharge to use the NHS during your stay:

  • Adults: Around £2,587.50 to £5,175
  • Children: Roughly £1,940 to £3,880

If you’re struggling financially, you might be able to apply for a fee waiver, especially if you can’t afford essential living costs.

And for those who want a quicker decision, the super priority service costs an extra £1,000, though it’s not available for all visa types.

Special cases and exceptions

Life doesn’t always go as planned, and the UK visa system has some flexibility in difficult situations.

You may still qualify for settlement if:

  • You were on a partner visa and your partner has died
  • You experienced domestic abuse while on a partner visa

In these cases, the law recognises that your situation may prevent you from meeting standard requirements.

When You can’t use a family visa

Not everyone can apply for this visa route. You’re not eligible if:

  • Your family member is in the UK on a temporary visa (like a student or work visa), in that case, you should apply as a dependant
  • You’re in the UK on a visitor or short-term visa and don’t meet the exceptions mentioned earlier.
