Canada Changes Rules for Spousal Work Permits Based on Job Types

The Canadian government has changed the rules for Spousal Open Work Permits (SOWP), now restricting them to certain job types. This affects the spouses of foreign workers in Canada, who now need to meet these new job requirements to qualify for a work permit.

Starting January 21, 2025, the new rules focus on allowing only spouses of foreign workers in specific important jobs to qualify. This does not change the status of those who already have permits or are renewing them, but it does change who can apply in the future.

New Rules for Spousal Open Work Permits

Now, spouses can only apply for the SOWP if their partner works in one of the following job types:

TEER 0 jobs

TEER 1 jobs

Some TEER 2 and TEER 3 jobs

Additionally, the foreign worker must have at least 16 months left on their work permit when applying for the SOWP. Previously, spouses could apply regardless of the job type of the foreign worker, but now, only specific jobs qualify.

Which Jobs Qualify?

The jobs that qualify include:

Technical jobs in science (NOC Codes 22300-22313), like civil engineering technologists and mechanical engineering technicians.

Technical health jobs (NOC Codes 32100-32209), like medical laboratory technologists and massage therapists.

Public protection services (NOC Codes 42102-43204), like early childhood educators and members of the Canadian Armed Forces.

Trades (NOC Codes 73100-73402), like concrete finishers, welders, and truck drivers.

How to Apply for a Spousal Open Work Permit

To apply for a SOWP, follow these steps:

1. Fill out the IRCC eligibility questionnaire to see if you qualify and to get a list of needed documents.

2 . Gather required documents, like proof of your relationship, proof of the principal applicant’s job, and confirmation that the foreign worker’s permit is valid for over 16 months.

3 . Submit your application online through the IRCC website, upload your documents, and pay the fees.

4. Wait for a decision. Processing times can vary depending on where you are and how busy IRCC is.

If the Job Doesn’t Qualify

If the foreign worker’s job doesn’t meet the new criteria, their spouse cannot apply for an SOWP under the new rules. However, if they received their work permit before the new rules started, they are not affected.

Spouses outside Canada can still apply for a SOWP if they meet all the requirements.
