Court Strikes Out Cybercrime Charges Against Man Accused of Threatening Kano Governor

A court has struck out cybercrime charges against a man accused of issuing threats against the Kano State Governor, Abba Kabir Yusuf.

The judicial decision followed an application by the prosecution lawyer to withdraw the charges against the accused individual. Upon the prosecution’s request, the judge formally struck out the case, effectively ending the legal proceedings regarding the alleged threats.

The case had centred on allegations that the man violated the Cybercrimes (Prohibition, Prevention, etc.) Act through digital communications directed at the Governor. The legal battle had drawn significant attention due to the political sensitivity of the target and the nature of the digital offences alleged.

Legal withdrawal of cybercrime allegations

In the Nigerian legal system, the withdrawal of charges by the prosecution typically occurs when the state determines that there is insufficient evidence to sustain a conviction or when other legal considerations necessitate the cessation of the matter. While the specific reasons behind the prosecution’s decision to withdraw the charges in this instance were not detailed in open court, the movement brings an immediate end to the litigation against the accused.

The use of the Cybercrimes Act to prosecute individuals for social media posts or digital messages targeting public officials has become an increasingly frequent occurrence in Nigeria. Such cases often sit at the intersection of national security concerns and the constitutional right to freedom of expression, frequently sparking debate among legal practitioners and civil society organisations.

Governor Abba Kabir Yusuf has been navigating a highly contested political landscape in Kano State, marked by ongoing tensions between various political factions. Any legal action involving the Governor or his administration often attracts heightened public scrutiny and media interest.

The prosecution has not yet issued a formal statement clarifying the underlying motives for the withdrawal of the charges or whether any further investigations into the alleged threats will be conducted through alternative legal channels.
