Is the Suspension of Senator Natasha Akpoti-Uduaghan Legal?

The Nigerian Senate’s recent suspension of Senator Natasha Akpoti-Uduaghan has sparked widespread outrage, with legal experts condemning it as unconstitutional and a blatant disregard for the rule of law. 

The decision to suspend the senator for six months, despite a court order barring any disciplinary action against her, has raised serious concerns about legislative overreach and the abuse of power.

The suspension came just a day after the Federal High Court in Abuja, presided over by Justice Obiora Egwuatu, restrained the Senate from proceeding with an investigation against Akpoti-Uduaghan. The court had directed the Senate to justify its actions within 72 hours, but instead of complying, the lawmakers went ahead to impose a six-month suspension.

This move has been widely criticized by legal professionals, who argue that the Senate had no legal basis to ignore a standing court order. Senior Advocate of Nigeria (SAN), Kunle Edun, strongly condemned the action, stating that legislative bodies do not have the power to override constitutional rights. 

According to him, even the Senate’s own rules do not support such a lengthy suspension. “Order 67(4) of the Senate Rules clearly states that a senator can only be suspended for a maximum of 14 days. Yet, the Senate went ahead to impose a six-month suspension, which is a clear violation of the law. This is an abuse of legislative power,” Edun remarked.

He further pointed out that since the matter was already in court, the Senate had no right to proceed with its disciplinary actions, as doing so violates the principle of sub judice, which prevents any institution from interfering in ongoing judicial proceedings.

Silencing a voice?

Many political analysts and activists believe that the suspension was not just about discipline but an attempt to silence Akpoti-Uduaghan. Her vocal opposition to Senate President Godswill Akpabio, whom she had accused of sexual harassment, has made her a controversial figure in the legislative chamber.

Human rights activist Deji Adeyanju described the Senate’s move as undemocratic and a direct attack on free speech. “This is not just an attack on Senator Akpoti-Uduaghan, but an attack on democracy itself. The Senate has shown that it is willing to silence dissenting voices instead of upholding justice and fairness,” Adeyanju stated.

He also raised concerns over the credibility of the Senate Committee on Ethics, which handled the case, pointing out that the committee chairman had previously defended Akpabio. This, according to Adeyanju, created a serious conflict of interest.

What led to the suspension?

The controversy surrounding Akpoti-Uduaghan’s suspension began on February 20, 2025, during a heated Senate session. She had protested the reassignment of her seat, a decision allegedly influenced by Akpabio. The matter was then referred to the Senate Committee on Ethics for investigation.

However, Akpoti-Uduaghan refused to appear before the committee, citing the court order that had restrained the Senate from probing her. Rather than respecting the court’s decision, the Senate proceeded with its disciplinary process and suspended her for six months.

Adding to the controversy, Akpoti-Uduaghan had recently re-presented her petition against Akpabio, which had previously been blocked. The timing of her suspension has led many to believe that it was a calculated attempt to prevent her from pushing forward with her claims.

A pattern of legislative intimidation?

This is not the first time a Nigerian senator has faced suspension under controversial circumstances. Former Senator Shehu Sani once revealed that he was nearly suspended for exposing the allowances received by lawmakers. 

Many believe that the Nigerian Senate has a history of using suspension as a weapon against outspoken members.

By suspending Akpoti-Uduaghan despite a court order, the Senate has raised fundamental questions about its commitment to the rule of law. If lawmakers themselves can ignore judicial rulings, what example does this set for the rest of the country?

What next?

Following her suspension, Akpoti-Uduaghan has vowed to continue representing her constituents, regardless of the Senate’s decision. She described her suspension as illegal and an affront to democracy.

“This illegal suspension does not take away my legitimacy as a senator. I was elected to serve the people of Kogi Central, and I will continue to do so, whether the Senate likes it or not,” she declared.

Legal experts argue that the only way to challenge this decision is through the courts. If the judiciary rules in her favor, it could set a precedent that prevents future legislative overreach.

For now, the suspension of Senator Akpoti-Uduaghan remains one of the most controversial political decisions in recent Nigerian history, sparking debates on the limits of legislative power and the need for stronger democratic institutions.
