NetNaija CEO Remanded in Kuje Over Copyright Infringement

The Federal High Court in Abuja has ordered the detention of Emmanuel Analike, Chief Executive Officer of NetNaija Media Enterprises, at the Kuje Correctional Centre. This is due to alleged copyright infringement related to digital content distributed through the NetNaija platform.

Analike faced charges on Wednesday before Justice Suleiman Liman at the Federal High Court of Nigeria. The Nigerian Copyright Commission (NCC) filed the case, which claims that copyrighted music and film materials were illegally reproduced and shared via the NetNaija website. The site is popular for providing downloadable entertainment content.

Court Orders Remand Pending Bail Decision

During the hearing, Analike pleaded not guilty to the charges. Justice Liman decided that he should remain in custody at the Kuje Correctional Centre until the court rules on his bail application, scheduled for March 9.

Analike’s lawyer, Nnemeka Ejiofor, told the court that a bail application had already been submitted, along with a 23-paragraph affidavit and written statement from earlier in the week. Despite this, the judge did not make an immediate ruling and postponed the matter instead.

Allegations of Online Piracy

Prosecutors claim that the charges against Analike arise from alleged online piracy. These include the possession, copying, and distribution of unauthorized copies of copyrighted works.

They argued that these actions broke Section 44(1)(a) of the Copyright Act, 2022. The Act prohibits the reproduction or distribution of protected works without authorization.

The four-count charge reportedly includes claims that the NetNaija platform made illegal copies of copyrighted works accessible to the public through digital means. The materials in question include recordings and audiovisual productions. These are movies, belonging to both Nigerian and international creators.

After the court session, Gladys Isaac‑Ojo, head of legal services at the NCC, described the arraignment as an important step in the fight against digital piracy.

“I am so excited that we were able to get him after all efforts. It is a huge success and something remarkable because of the joy it would bring to the commission,” she said, according to reports.

Isaac-Ojo pointed out that the commission’s case targets both Analike and the company allegedly involved in the offense.

“He committed the act through his company, so that’s why we charged him and his company,” she stated, noting that NetNaija operates as an online movie and music distribution site.

She also noted that the defendant has the right to apply for bail, and it will be up to the court to decide on that request.

Broader Implications for Nigeria’s Digital Content Industry

This case has drawn attention in Nigeria’s entertainment and technology sectors. So far, there are ongoing concerns about digital piracy. Unauthorized copies of films and music on online platforms are seen as a serious threat to the economic viability of creators and production companies.

By taking this case to the Federal High Court, the NCC seems to be showing a stronger effort to enforce the Copyright Act, 2022.

Legal analysts believe the outcome may influence how authorities regulate digital distribution platforms and protect intellectual property in Nigeria’s rapidly growing online entertainment market.

For now, Analike remains in custody at the Kuje Correctional Centre as the court prepares to decide on his bail application and the next steps in the trial.
