The People’s Democratic Party (PDP) has officially distanced itself from a legal petition seeking to overturn Governor Ademola Adeleke’s victory in the Osun State governorship election. The party has declared that it did not authorise the legal challenge and is now moving to contest the legitimacy of the lawyers claiming to act on its behalf.
This rejection marks a significant legal complication following the August 15, 2026, polls. By disavowing the petition, the PDP is challenging the authority of the counsel who filed the suit, asserting that the legal action does not reflect the official position or the interests of the party leadership.
The party’s stance comes as a direct response to a petition filed to challenge the outcome of the Osun State governorship election, which had been presented to the public as an official party-led initiative.
Legal dispute over party representation
In a formal statement, the party leadership clarified that the legal proceedings have no official backing or financial support from the organisation. The party expressed concern over the unauthorised use of its name to pursue litigation.
“We are here to tell you that the PDP did not authorise this petition. It is not our case. The party neither instituted, sponsored, approved, nor endorsed the petition challenging the outcome of the 15 August 2026 Osun State Governorship Election,” the party stated.
The controversy centres on the identity and authority of the legal team. While the petition is being presented as a move by the PDP to contest Governor Adeleke’s mandate, the party’s official structure has denied any involvement, sponsorship, or approval of the litigation. This creates a potential crisis of standing, as the party seeks to protect its institutional integrity against what it views as an unauthorised legal manoeuvre.
In Nigerian election law, the ability of a party to challenge a result depends heavily on the authority of the legal representatives to act on the party’s behalf. If the court determines that the purported counsel lacked the necessary mandate from the PDP leadership, the petition could be struck out for lack of locus standi or improper instruction.
