ADC appeals Atiku Abubakar’s presidential ticket annulment

The African Democratic Congress (ADC) has filed an appeal and a stay application to challenge a Federal High Court judgement that invalidated the party’s leadership and the presidential nomination of Atiku Abubakar.

The move follows a court ruling that struck down the legitimacy of the party’s current leadership structure and its candidate nominations. Through its campaign team, the ADC has urged the Independent National Electoral Commission (INEC) to withhold any administrative action regarding the party’s status or its presidential ticket until the Court of Appeal has concluded its proceedings on the matter.

The ADC’s legal move to appeal the annulment of Atiku’s presidential ticket seeks to prevent the immediate enforcement of the lower court’s decision, which has direct consequences for the party’s participation in the upcoming electoral cycle.

Legal battle over ADC leadership and candidate status

The legal challenge centres on the Federal High Court’s decision to invalidate the party’s leadership and, by extension, the candidacy of the former Vice-President. By filing a stay application, the ADC is attempting to maintain its current standing and prevent INEC from removing Atiku Abubakar from the list of eligible presidential candidates before the higher court has reviewed the case.

The stay application is intended to prevent what the party describes as irreparable damage to its political operations. In Nigerian electoral law, such applications are used to pause the execution of a court order to ensure that the status quo is preserved while an appellate court determines the validity of the initial judgement.

For INEC, the situation presents a procedural challenge. The commission is legally required to comply with judicial orders, yet the ADC is arguing that acting on the High Court’s ruling before the appeal is heard could undermine the judicial process. If the commission proceeds with the nullification of the ticket, Atiku Abubakar’s candidacy could be effectively terminated regardless of the eventual outcome at the Court of Appeal.

The nullification of the leadership also creates uncertainty regarding the party’s ability to manage its internal affairs or participate in upcoming political activities. The ADC’s legal team contends that the dispute over its internal structure must be resolved by the appellate court to ensure that the party’s democratic processes are not summarily overturned by a single judicial decision.

The political stakes remain high for the ADC and the Atiku Abubakar campaign, as the ruling threatens the party’s ability to field a candidate in the presidential race. The next step depends on the speed at which the Court of Appeal processes the stay application and the subsequent appeal, while political observers await a response from INEC regarding its position on the matter.
