Tinubu transmits bill to Senate to bring convicted Nigerians home

President Bola Tinubu has transmitted a bill to the Senate that would allow the Nigerian government to transfer convicted citizens currently serving sentences in foreign countries back to Nigeria.

The proposed legislation seeks to provide the executive arm of government with the legal authority to enter into bilateral agreements with other nations. These agreements would facilitate the repatriation of convicted offenders, allowing them to serve their prison terms within the Nigerian correctional system.

The move follows the transmission of the bill to the Senate, which aims to formalise the legal process for prisoner transfers and enhance judicial cooperation between Nigeria and the international community.

Under the current legal framework, the repatriation of convicted Nigerians is often hindered by the absence of specific treaties and formalised arrangements between Nigeria and the countries where the offences were committed. This lack of a streamlined process often results in Nigerians serving lengthy sentences in foreign correctional facilities, which can lead to diplomatic and administrative complexities.

Establishing bilateral judicial cooperation

The new bill is intended to create a structured mechanism for judicial cooperation between Nigeria and its international partners. By establishing a clear legal basis for prisoner transfers, the government can negotiate specific terms regarding the conditions of transfer, the type of offence committed, and the management of the inmates upon their return.

Legal analysts note that such legislation is common in many jurisdictions to manage the affairs of citizens living abroad. It allows the home country to maintain more direct involvement in the rehabilitation and supervision of its citizens, while also potentially reducing the diplomatic friction caused by foreign incarceration.

The implementation of the bill will likely involve close coordination between the Ministry of Justice, the Ministry of Foreign Affairs, and the Nigerian Correctional Service. The Correctional Service will be responsible for ensuring that facilities are equipped to handle transferred inmates and that the terms of the foreign sentences are strictly adhered to within Nigerian borders.

The Senate is expected to begin deliberations on the bill during its upcoming sessions. Once the legislative process is completed and the bill receives presidential assent, the federal government will be able to begin formal negotiations with other countries to implement prisoner transfer treaties.
